Portugal Golden Visa and the Nationality Law Dispute: Our CEO on CNN Portugal

Our company, Golden Path Investment, was invited by CNN Portugal to address one of the most debated questions in the investment migration market: the collective lawsuit being prepared by hundreds of Golden Visa holders against the Portuguese State.

Our CEO and Founder, Pedro Pires e Borges, represented Golden Path Investment in the interview, analyzing the legal, economic, and strategic dimensions of the Portugal Golden Visa at a moment of heightened regulatory uncertainty.

The case originates in a report by the Portuguese weekly Expresso: a group of investors, represented by one of Portugal's largest law firms, is contesting amendments to Portugal's nationality law that extended the minimum legal residence period required to begin a citizenship application. The association formed for this purpose unites thousands of Portugal Golden Visa holders and applicants, with international judicial appeals planned if domestic proceedings are unsuccessful.

The interview covers three main areas: what is legally at stake, the economic weight of the program, and what changes in practice for investors already in the process.

The most common questions investors ask about the Portugal Golden Visa and the nationality law dispute, explained by our CEO Pedro Pires e Borges

What is being contested in the lawsuit?

The legal action challenges a nationality law amendment that extended the minimum period of legal residence required to apply for Portuguese citizenship. Plaintiffs argue the new framework undermines legitimate expectations formed under earlier legislation, specifically the possibility of accessing Portuguese citizenship within a five-year window. Appeals to international judicial bodies are on the table if domestic proceedings do not rule in the plaintiffs' favor.

Is the Portugal Golden Visa a citizenship program?

No, and this is the distinction our CEO emphasized most clearly in the interview. The Portugal Golden Visa is a residence-by-investment mechanism, not a citizenship pathway. Portuguese citizenship is a parallel possibility, accessible over time by meeting residency and language requirements, but it is not the stated objective of the Golden Visa itself. The Portuguese government has argued the same: investors who pursued the Portugal Golden Visa with an expectation of citizenship on a fixed timeline may have conflated two legally distinct processes. For a deeper look at how the naturalization pathway works alongside US citizenship, see our guide on dual nationality for American investors.

“The Golden Visa, per se, remains the same. What the government says is that, effectively, since it is not a citizenship process, there is no frustration of clients' expectations here.”  — Pedro Pires e Borges, CEO of Golden Path Investment, CNN Portugal

What is the economic weight of the Portugal Golden Visa investment fund route?

It is substantial and structurally directed toward the domestic economy. Under current CMVM regulations, Portugal Golden Visa investment funds are required to direct a minimum of 60 to 65 percent of capital into Portuguese companies, across sectors including renewable energy, education, and exchange-listed firms. On the donations route, recently published data show that 46.5 million euros were directed to cultural and artistic purposes in a single year. For a full breakdown of the costs involved across the program, see our Portugal Golden Visa total cost breakdown.

“The investment is made through the funds. The funds, in turn, invest in Portuguese companies. So it is a direct investment into the Portuguese economy.”  — Pedro Pires e Borges, CEO of Golden Path Investment, CNN Portugal

Does the lawsuit put existing investments at risk?

The structural risk to capital already deployed is limited, but the reputational signal is significant. Investment made through fund vehicles remains allocated to Portuguese companies regardless of the judicial outcome. The concern we raised in the interview is the signal an unstable legal environment sends to prospective investors, particularly Americans evaluating Portugal Golden Visa options. We called for restraint on both sides: escalation serves neither the State nor existing holders.

“Portugal cannot refuse this investment. We need to safeguard legal certainty here, because the investment is beneficial to our economy.”  — Pedro Pires e Borges, CEO of Golden Path Investment, CNN Portugal

Does the Portugal Golden Visa still make sense given this uncertainty?

Structurally, yes. The current framework is built around CMVM-regulated investment funds with mandatory domestic allocation. The legal uncertainty relates specifically to the nationality amendment and does not affect the fundamental conditions of the Portugal Golden Visa or the existing investment requirements under current rules. For investors focused on the residency benefit, the core mechanics remain intact.

Golden Path Investment on CNN Portugal: what this moment reflects

Being invited by CNN Portugal to address one of the most complex debates in the investment migration market reflects the position we have built with investors, lawyers, and specialist journalists over the years. Our CEO's presence in the interview is not incidental: it results from direct operational experience managing the Portugal Golden Visa process end to end, from fund selection through residence obligation management to the long-term naturalization pathway.

The nationality law debate has concrete implications for investors already in the process. But as we made clear throughout the interview, the Portugal Golden Visa is a residence-by-investment instrument, and its structural viability is not undermined by the legislative amendments currently in dispute. Separating the residence layer from the naturalization pathway is the starting point for any informed evaluation, whether the investor is at the entry stage or approaching the Year 5 decision.
